SMS Compliance Policy for Customers

1. Purpose
This SMS Compliance Policy outlines the guidelines and requirements for sending and receiving SMS messages to ensure compliance with applicable laws and regulations, including those set forth by the Telephone Consumer Protection Act (TCPA), General Data Protection Regulation (GDPR), and other relevant local laws.

2. Scope
This policy applies to all businesses, employees, and third parties engaged in the collection, storage, and transmission of customer data via SMS for marketing, transactional, or support purposes.

3. SMS Consent

  • Opt-In Requirement: Customers must provide explicit consent to receive SMS communications. This can be achieved through a clear opt-in process, such as checking a box or confirming their consent via SMS.
  • Opt-Out Option: Every SMS message must include an option for customers to opt-out of receiving further messages. For example, including the phrase "Reply STOP to unsubscribe" in the message.
  • Clear Disclosure: When obtaining consent, businesses must inform customers about the types of SMS messages they will receive, whether marketing or transactional, and that message and data rates may apply.

4. Data Privacy and Protection

  • Customer Data Handling: Businesses must ensure that all customer data, including phone numbers, is handled with strict confidentiality and in compliance with applicable privacy laws.
  • Third-Party Providers: If third-party vendors or services are used to send SMS messages, these vendors must also comply with all applicable laws and regulations related to SMS communication and data privacy.

5. Message Content

  • Clear and Honest Communication: All SMS messages must be clear, honest, and not misleading. This includes ensuring that the sender's identity is easily identifiable and that the message content matches the purpose of the consent.
  • Marketing Messages: Any marketing SMS must contain a clear call to action, such as how the customer can learn more, redeem offers, or contact the business for further information.

6. Message Frequency

  • Frequency Limits: Businesses must avoid sending excessive or spam-like SMS messages. Clear guidelines regarding the maximum number of messages customers will receive should be communicated when obtaining consent.
  • Frequency Disclosure: When collecting consent, businesses must disclose how often customers can expect to receive SMS messages (e.g., "up to 4 messages per month").

7. Compliance with Regulatory Requirements

  • TCPA (Telephone Consumer Protection Act): Businesses must comply with TCPA regulations, including obtaining prior express written consent for marketing messages, maintaining records of consent, and avoiding the use of automated dialers for SMS marketing without consent.
  • GDPR (General Data Protection Regulation): For customers in the EU, businesses must ensure compliance with GDPR by providing transparent information on data usage, obtaining consent before collecting personal data, and allowing customers to easily withdraw consent.

8. Monitoring and Auditing

  • Internal Audits: Businesses must regularly review and audit their SMS marketing practices to ensure compliance with this policy, applicable laws, and industry standards.
  • Customer Feedback: Businesses should encourage customer feedback regarding SMS communications and promptly address any complaints or concerns.

9. Enforcement and Penalties

  • Violations: Any violations of this policy or applicable laws may result in corrective actions, including suspension of SMS campaigns, staff training, or penalties for non-compliance.
  • Legal Consequences: Failure to comply with SMS marketing regulations may result in fines, legal action, and reputational damage for the business.
